The purpose of the public hearing, held on Oct. 11 at the Zoning Administration office, was to determine whether or not US Copper Corp has vested mining rights to two claims on the Engels Mine property.

A finding of vested mining rights means that the mine operator would not have to file a mine permit with the county, would not have to follow CEQA regulations in the planning phase and would not have to file county permits for grading roads, landings or building sites. This is not a determination as to whether or not there can be a mine on the property. This is a matter of the county being able to retain as much of its rights as possible and the mine operator being held to the highest environmental standard possible. The determination of the existence or non-existence of vested mining rights (operator does not or does, have to get permits, follow CEQA respectively) falls on Interim Zoning Administrator, Jim Graham. The staff report provided to Mr. Graham reads to support the finding of vested rights. However, based on the importance of these findings, the volume of material to read and understand and the comments shared by our fellow community members at the 10/11 meeting, Mr. Graham has decided to keep the public hearing open until December 13, 2023 so that the community has more time to weigh in and so that he has time to digest the information which has been provided to him. This is a great opportunity to learn about US Copper's intentions with this property, how we can be involved in shaping the future of our home (whether or not the mine happens) and to give feedback to those who hold these decisions for us.
